1. Binding Service Agreement
By requesting a free estimate, submitting a service request via our online forms, calling our office, messaging us on WhatsApp, or contracting G.H. Landscaping ("we," "us," or "our") to perform residential or commercial lawn care or landscaping services, you ("Client") agree to be legally bound by these Terms & Conditions. These terms operate as our primary service agreement and govern all quotes, invoices, and physical landscaping labor executed on your property.
2. Landscaping & Lawn Care Services Provided
G.H. Landscaping delivers professional lawn care, cleanups, softscaping, and property restorations. The specific services to be performed will be outlined in a detailed project proposal or estimate agreed upon by both parties. Standard services follow professional landscaping parameters:
- Lawn Mowing: precision cutting at the recommended height (typically 2.5 to 3.5 inches depending on grass type and weather conditions). Includes trimming around beds and structures, and blowing grass clippings off hard surfaces.
- Edging & Bed Maintenance: Establishing sharp, clean vertical borders along walkways, patios, and garden beds, and applying premium mulch or rock layers as specified in your estimate.
- Seasonal Cleanups: Removal of organic lawn debris, leaves, twigs, and expired plant growth in spring and fall viewports.
- Aeration, Dethatching, and Seeding: Soil aeration and overseeding to relieve soil compaction and introduce fresh, drought-resistant grass seeds.
- Plant and Shrub Installation: Installing localized trees, decorative shrubs, and flowers according to customized garden layout maps.
3. Estimates, Quotes, and Scope Adjustments
All estimates are calculated based on observations of property conditions, slope, complexity, grass length, and specific materials required. Quotes are valid for exactly thirty (30) days from the date of issuance. If the property's state changes significantly between the time of estimate and the scheduled date of service (such as excessive grass overgrowth, storms depositing heavy branches, or new structures erected), G.H. Landscaping reserves the right to adjust the final price or invoice for the additional labor required, which will be communicated immediately via phone call or WhatsApp message.
4. Weather post-ponements & Flexible Scheduling
Due to the nature of professional outdoor labor, G.H. Landscaping schedules are highly dependent on weather conditions. Inclement weather (including heavy rain, thunderstorms, waterlogged soils, or extreme heat warnings) may force safety postponements. While G.H. Landscaping strives to maintain consistent service days (e.g., every Tuesday), all scheduled times are approximate scheduling windows. Postponed sessions are automatically rolled to the next available dry working day. We will provide updates regarding weather adjustments directly via WhatsApp or phone.
5. Payment Terms, Billing Cycle, and Deposit Requirements
Client agrees to fulfill all payment obligations under the following parameters:
- Invoicing: Invoices are sent electronically upon service completion or on a monthly cycle for recurring clients. Payment is due in full within fifteen (15) days of invoice issuance (Net 15).
- Deposits for Major Projects: Any custom softscaping, sod installation, or extensive yard transformation exceeding $1,000 requires a **50% deposit upfront** to secure materials and scheduling, with the remaining 50% due immediately upon final completion.
- Late Payment Penalties: Late balances accrue interest at a rate of 1.5% per month. Recurring services may be paused if invoices remain unpaid past 30 days. In the event collection actions are required, Client agrees to reimburse G.H. Landscaping for all collection agency fees, court costs, and reasonable attorney fees.
6. Property Access, Safety Guidelines, and Gate Dimensions
To ensure a safe, high-end, and efficient landscape operation, Client commits to the following:
- Access: Gates must be unlocked and driveways or entry paths must be clear of obstructions on scheduled service days. Gates must accommodate our commercial mowers (minimum 48-inch clearance). If access is restricted, we reserve the right to invoice a trip fee or skip inaccessible lawn zones.
- Safety Obstacles: Lawn fields must be entirely clear of dog waste, children's toys, hoses, sports equipment, large stones, or metallic debris. Our mowers run high-speed steel blades; hitting hidden yard objects poses high safety hazards to our crew and can damage customer property or our machinery.
- Pet Policy: All dogs, cats, and pets must be secured indoors during service hours.
7. Liabilities and Underground Exclusions (JULIE One-Call)
G.H. Landscaping maintains comprehensive general liability insurance coverage and workers' compensation. However, specific structural damage exclusions apply:
Underground Utilities: Before we perform any deep excavation, aeration, or planting, public utility lines must be mapped by the local one-call system (JULIE). G.H. Landscaping is not liable for damage to unmarked private underground lines, including shallow irrigation tubes, landscape lighting wires, drainage pipes, invisible dog fence wiring, or shallow internet cables not officially documented and clearly marked by JULIE or explicitly detailed by the Client in writing prior to our arrival.
8. Plant and Sod Survival Warranty
We source premium, healthy sod and native plants from local nurseries. While we guarantee professional, expert installation following best agricultural practices, G.H. Landscaping does not provide any warranty on plant, sod, or tree survival once our crew departs. The survival of transplants depends entirely on proper post-installation watering, weeding, soil maintenance, and climate exposure. We will provide detailed watering instructions upon project completion; Client assumes all responsibility for ongoing watering and maintenance.
9. Terminations, Cancellations, and Governing Laws
Client may terminate recurring weekly lawn maintenance packages by providing fourteen (14) days written notice to our corporate office. These terms and conditions are governed by and construed in accordance with the laws of the State of Illinois, USA. Any legal action or dispute arising from our service, invoicing, or property management must be filed in the state courts operating in DuPage or Kane Counties, IL.
